Looking at the ages of the children, it appears that Carrie had a child born between Murl and Susie. United States marshals from Gainesville arrested J. M. Neal, James and Caleb Yarbrough and Stacy Linderman in Maysville on the charges. One local paper commented that "We hope they will be able to prove their innocence from such severe charges. On August 11th they appeared before Commissioner Dunlap in Gainesville. They were represented by Howard Thompson and H. W. J. Ham. After a number of delays, the case came up for trail in October. By this time several others had been added to the list of defendants, which now included Jasper Yarbrough, James Yarbrough, Dilmus Yarbrough, Neal Yarbrough, Lovel Streetman, Bold Emory, and E. H. Green. The jury was chosen and consisted of both blacks and whites. It was noted that they were indicted based on a section of the revised statutes relating to protected political expression. They were charged with whipping the blacks for voting for a certain candidate in the congressional race. They were found guilty and placed in the Fulton County jail while their lawyers worked to secure a new trail.
